Shipping, Delivery and Pickup
This Shipping, Delivery and Pickup Policy applies to business-to-business orders fulfilled by Gulf Poly Pipe LLC. It supplements the Sales Terms and Conditions. The accepted quotation or Order Acknowledgment controls if it expressly states different shipping terms.
1. Shipping terms shown on the order
Each quotation or Order Acknowledgment should identify the applicable arrangement, such as:
- Customer Pickup;
- FOB Shipping Point;
- Freight Prepaid and Added;
- Freight Included;
- Delivered to Named Destination; or
- another written shipping term.
A statement that freight is “included” addresses price allocation and does not by itself determine risk of loss. The accepted Order Acknowledgment will control.
2. Customer pickup
For Customer Pickup:
- the Customer or its carrier is responsible for transportation;
- the Customer must provide accurate carrier and driver information when requested;
- the driver must comply with mill, supplier, yard, and facility requirements;
- the driver must present the applicable release number, order number, or pickup authorization;
- the Customer is responsible for suitable equipment, legal load limits, securement, permits, and route compliance; and
- risk of loss passes when the material is released to the Customer, its driver, or its carrier at the shipping point.
Pickup appointments and release numbers are not transferable without written authorization.
3. Gulf Poly Pipe-arranged freight
When Gulf Poly Pipe arranges freight, the quotation or Order Acknowledgment will state whether freight is included, prepaid and added, or invoiced separately.
Gulf Poly Pipe may select the carrier, shipment origin, routing, equipment type, and reasonable delivery sequence unless the Customer’s written requirements are accepted before the order is released.
Carrier schedules remain subject to availability, hours-of-service rules, weather, traffic, mill loading, and other transportation conditions.
4. Delivered orders
For a delivered order, the Customer must provide:
- complete delivery address and site contact;
- accurate access instructions;
- legal and safe truck access;
- adequate turning, staging, and unloading space;
- any gate, security, appointment, or escort requirements;
- notice of road, bridge, height, weight, mud, or jobsite restrictions; and
- suitable unloading equipment and trained personnel.
Unless the accepted Order Acknowledgment says otherwise, Gulf Poly Pipe and the carrier are not responsible for unloading.
5. Delivery estimates
Quoted ship dates, delivery dates, and lead times are good-faith estimates, not guarantees, unless Gulf Poly Pipe expressly guarantees a date in a signed writing.
Lead time may begin only after all applicable conditions are satisfied, including:
- order acceptance;
- receipt of required deposit or payment;
- credit approval;
- final specification confirmation;
- approved submittals;
- supplier acknowledgment;
- confirmed release instructions; and
- complete delivery information.
6. Required-on-site dates
The Customer must disclose the actual required-on-site date before order acceptance. Gulf Poly Pipe is not responsible for a project deadline, shutdown, crew schedule, or liquidated-damages exposure that was not disclosed and expressly accepted in writing.
7. Unloading
The Customer is responsible for safe and prompt unloading unless the accepted order expressly includes unloading services.
The Customer must not require a driver to:
- enter an unsafe or unsuitable area;
- operate Customer equipment;
- climb on unsecured pipe;
- perform rigging not included in the carrier’s scope; or
- remain beyond a commercially reasonable unloading period without applicable charges.
8. Detention, demurrage, redelivery, and storage
The Customer is responsible for additional costs caused by:
- delayed unloading;
- missed appointments;
- inaccurate delivery information;
- unavailable personnel or equipment;
- unsafe site conditions;
- rejected delivery not caused by Gulf Poly Pipe;
- delivery-location changes;
- truck ordered but not used;
- redelivery;
- storage;
- split deliveries requested after order acceptance; or
- carrier detention or layover.
These charges may be invoiced after delivery even if freight was originally quoted as included.
9. Partial and multi-origin shipments
Orders may ship in multiple loads or from multiple origins because of truck capacity, mill allocation, product availability, or project sequencing.
Separate freight may apply to multi-origin, accelerated, split, or partial shipments unless the quotation expressly includes those costs.
10. Changes to shipping instructions
Delivery location, contact, appointment, timing, carrier, or routing changes must be submitted in writing.
A change is not effective until Gulf Poly Pipe confirms acceptance. The Customer is responsible for resulting freight, storage, reconsignment, detention, cancellation, or price differences.
11. Risk of loss
Unless the accepted Order Acknowledgment states otherwise:
- Customer Pickup and Customer-arranged freight are FOB Shipping Point, with risk passing upon release to the Customer or carrier.
- For a delivered order, risk passes when the shipment arrives at the stated delivery location and is made available for unloading.
- If the Customer refuses, delays, or cannot accept a conforming shipment, risk and resulting charges may pass when delivery is tendered.
12. Inspection at receipt
The Customer must inspect the shipment before signing the delivery receipt or pickup document.
The Customer should verify:
- pipe size;
- DR or SDR;
- joint or coil length;
- quantity;
- markings;
- visible condition;
- fittings and accessories; and
- documentation delivered with the load.
Visible damage, shortage, or discrepancy must be written on the carrier’s document before departure. The Customer should photograph the load and affected material.
13. Carrier claims
Carrier-related damage or shortage claims require prompt documentation. The Customer must preserve packaging, dunnage, banding, photographs, delivery documents, and affected material until the claim is resolved or inspection is waived.
Gulf Poly Pipe will reasonably assist with a claim when Gulf Poly Pipe arranged the carrier, but claim approval remains subject to the carrier’s rules and available evidence.
14. Unsafe or restricted conditions
Gulf Poly Pipe or the carrier may refuse to enter or unload at a location reasonably believed unsafe, inaccessible, illegal, or likely to damage equipment or property.
Any alternate delivery, waiting, return, or storage cost is the Customer’s responsibility unless the unsafe condition resulted solely from Gulf Poly Pipe’s error.
